  3. DISCLAIMER

  5. Kevin Rintoul disclaims all warranties relating to this software, whether 
  6. express or implied including, but not limited to any implied warranties of 
  7. merchantabilities and fitness for a particular purpose, and all such 
  8. warranties are expressly and specifically disclaimed. Neither Kevin Rintoul 
  9. nor anyone else who has been involved in the creation, production or 
  10. delivery of this software shall be liable for any indirect, consequential or 
  11. incidental damages arising out of the use or inability to use this software, 
  12. even if Kevin Rintoul has been advised of the possibility of such damages or 
  13. claims. In no event shall Kevin Rintoul's liability for any damages ever 
  14. exceed the price paid for the license to use the software, regardless of the 
  15. form of claim.  The person using the software bears all risk as to the 
  16. quality and performance of the software.

  18. Some states do not allow the exclusion of the limit of liability for 
  19. consequential or incidental damages, so the above limitation may not apply 
  20. to you.

  22. This agreement shall be governed by the laws of the Province of British 
  23. Columbia and shall inure to the benefit of Kevin Rintoul, and any 
  24. successors, administrators, heirs and assigns. Any action or proceeding 
  25. brought by either party against the other, arising out of or related to this 
  26. agreement shall be brought only in a Provincial  Court of competent 
  27. jurisdiction located in the Victoria, British Columbia, Canada.  The parties 
  28. hereby consent to in personam jurisdiction of said courts.

  30. Simply stated: If you would sue me if my software broke something, please do 
  31. not use my software.

  35. Sysops: Feel free to download the complete version and post it on your 
  36. bulletin boards.

  38. Diskette Distributors and CD-ROM publishers:  Feel free to 
  39. download and publish it on your CD-ROMs and diskettes 
  40. provided that:
